STALLION SERVICE CONTRACT

THIS AGREEMENT is made and entered into this day and month written below between FRENCH POINT PAINT & QUARTER HORSES of Bonners Ferry, IDAHO ("Stallion Owner") and ___________________________________ ("Mare Owner").

These parties agree as follows:

To HES OBVIOUSLY SMOOTH standing at TJ Enterprises, Rathdrum, IDAHO for the ______________ Breeding season and to pay the breeding fee together with the other expenses specified herein.

2.

The Stallion Service Fee shall be $500.00. All unpaid board and expenses to be paid when the mare is picked up. The mare will not be released to the owner or his representative until all fees are paid to date unless prior written arrangements have been made between  both parties.

3.

Board shall be set as follows: MARE CARE: $__________ @ day dry and $__________ @ Day wet. All board and expenses on mare and/or foal shall be paid before departure unless other options are agreed upon in writing, and are due upon receipt of invoice.

4.

Breeder will exercise judgment consistent with recognized standards in care and supervision of mare and/or foal. Breeder assumes responsibility for arranging veterinarian and farrier services as necessary. Breeder’s veterinarian will examine mare for normal breeding conditions and administer medical care as deemed necessary for the health and safety of the mare and/or foal. The Owner will pay for all veterinary expenses and all farrier expenses

5.

Mares that are not halter broke will not be accepted. The Mare shall not be shod on the back feet.

6.

The Mare will be in a healthy and sound breeding condition, free from infections, contagious or transmissible disease. A current negative Coggins Test (out-of-state mares only). Photostatic copy of registration papers (both sides), plus a health, worming and immunization record must accompany mare: if they do not, Breeder’s veterinarian will examine and/or test mare at Mare Owner’s expense. Breeder reserves the right to refuse mare if not in satisfactory condition.

7.

Stallion Owner or Stud Manager shall not be liable for injury, sickness, or death of mare and/or foal, regardless of how it may occur.   Likewise, Mare Owner shall not be liable for disease, injury, or death to the Stallion arising out of the services contracted for in this agreement.

8.

Stallion Owner shall attempt with reasonable diligence to settle Mare; if, however, for any reason the Mare does not settle, the Mare Owner will hold Stallion Owner and Stud Manager harmless. The breeding season for the Stallion begins February 1 and closes July 1 at which time breeding will be discontinued.

9.

Stallion Owner guarantees a live foal from the breeding contracted for herein. Live foal is defined as a foal that stands and nurses without assistance. Should the Mare prove not to be in foal in the year bred or lose her foal, or should the foal not stand and nurse without assistance, Mare Owner shall notify the Stallion Owner in writing within one week of foaling date (or the date the Mare is proved not to be in foal or loses her foal); such notice shall be accompanied by a statement from a licensed veterinarian verifying that the foal is not "live" as defined above or had been lost as stated above. Under the foregoing circumstances and upon receipt of the specified notice, it is agreed.

10.

a.  Stallion Owner shall give Mare Owner breeding with a Chute fee of $200.00 to the Stallion the following year only, and to the same Mare originally booked (unless otherwise mutually agreed in writing between Mare Owner and Stallion Owner.)

b.  If Mare Owner fails to deliver the Mare (or a substitute Mare if mutually agreed as stated above) for the rebreeding the following year, then any and all fees paid shall not be refundable, the right to rebreed is thereby cancelled and the Stallion Owner is released from any further obligation whatsoever.

11.

This contract shall not be transferable by Mare Owner without the prior written consent of Stallion Owner. A Breeder’s Certificate will be issued when the Mare Owner notifies French Point Paint And Quarter Horses of the birth of the foal and only after payment of all bills due on the Mare has been received. This agreement constitutes the entire agreement between the parties: any amendments to or modifications of the terms of this agreement must be in writing.

12.

Should it become necessary for Stallion Owner to employ an attorney to enforce any of the terms of this agreement, including collection of money owed, Mare Owner shall pay all reasonable attorney’s fees, cost of suits, and other expenses reasonably related to enforcing this agreement.
